Acceptance of Terms

We, at ImmigrationWatch.com,  provide you the services including but not limited to Directory Service, E-mail service, Alert Service (the "Service") which are subject to the following Terms of Service (the "Terms of Service" or "TOS"), which may be updated by us from time to time without notice to you. The following terms and conditions, and any amendments thereto, and our Terms of Use (the "Terms of Use" or "TOU") and Privacy Policy govern your use of this web (the "Web") site. By registering as a member or visiting the Web, you agree to abide by the following terms and conditions in addition to our TOU. If you do not accept these conditions, do not use the Web. The latest TOS will be posted on the Web site, and you should always review these Terms of Service prior to using the services provided on the Web site to ensure that you have a current understanding of the Terms of Service.

Membership and Obligation

Membership is required for the use of Service and is subject to prior approval of ImmigrationWatch.com. ImmigrationWatch.com reserves the right and without liability to refuse its service to any new or existing members for any reason, in its sole discretion. Without limiting the foregoing,  ImmigrationWatch.com reserves the right to require potential or existing directory service members to submit detailed descriptions or explanations or legal proof of certain contents or entities for directory list on the Web site. Refusal to provide complete information constitutes grounds for non-acceptance or termination from your use of the service.

While registering membership, you represent and warrant that you are of legal age to form a binding contract and are not a person barred from receiving services under the laws of the United States or other applicable jurisdiction. You also agree to: (a) provide true, accurate, current and complete information about your yourself, your firms and all lawyers associated with your firms; (b) maintain and promptly update the above registration information to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or ImmigrationWatch.com! has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, ImmigrationWatch.com has the right to suspend or terminate your membership and refuse any and all current or future use of the Service (or any portion thereof). 

You will receive a password and account designation upon completing the Service's registration process. You are responsible for maintaining the confidentiality of the password and account, and are fully responsible for all activities that occur under your password or account. You agree to immediately notify ImmigrationWatch.com of any unauthorized use of your password or account or any other breach of security. ImmigrationWatch.com cannot and will not be liable for any loss or damage arising. 

Content (of Firm & Lawyer List, News Items and Website) & Indemnity

You represents and warrants that all information, data, text, graphics, messages or other materials ("Content"): (1)  is truthful, accurate and complete, and is not misleading in any way; (2) do not violate any applicable law or regulation, including, without limitation, false advertising or unfair competition; (3) do not infringe in any manner any copyright, patent, trademark, trade secret or other intellectual property right of any third party; (4) do not breach any duty toward or rights of any person or entity including, without limitation, rights of publicity or privacy, and have not otherwise resulted in or are not likely to result in any consumer fraud, product liability, tort, breach of contract, injury, damage or harm of any kind to any person or entity; (5) are not defamatory, libelous, slanderous or threatening, 

Further,  you understand that the Content, whether publicly posted or privately transmitted, are the sole responsibility of the person from which such Content originated. This means that you, and not ImmigrationWatch.com, are entirely responsible for all Content that you upload, post, transmit or otherwise make available via the Service. ImmigrationWatch.com, does not control the Content posted via the Service and, as such, does not guarantee the accuracy, integrity or quality of such Content. Under no circumstances will ImmigrationWatch.com be liable in any way for any Content, including, but not limited to, for any errors or omissions in any Content, or for any loss or damage of any kind incurred. You agree to indemnify, defend and hold immigrationWatch.com and its subsidiaries, officers, operators, agents, partners, and employees, harmless from any claims, liabilities, damages, losses, expenses, including reasonable attorney's fees, made by any third party due to or arising out of, based on or in connection with use of any Content you posted, emailed, transmitted or otherwise made available via the Service.


Termination

ImmigrationWatch.com reserves the right to, under certain circumstances, in ImmigrationWatch.com's sole discretion and without prior notice, immediately terminate your account, all or part of service associated with the account. Cause for such termination includes, but not be limited to, (a) breaches or violations of the TOS or TOU or other incorporated agreements, (b) requests by law enforcement or other government agencies, (c) requests by yourself  (d) extended periods of inactivity, (e) nonpayment of any fees owed by you in connection with the Services. 

Upon termination, (a) all connection with and access to the Service will be permanently severed, (b) files and contents associated with your account will be permanently deleted, (c) barring further use of the Service.

 

Disclaimer of Warranties and Limitation of Liability

YOU AGREE TO INDEMNIFY AND HOLD THE SERVICE PROVIDER, IMMIGRATIONWATCH.COM, THE MANAGING OPERATORS, ADMINISTRATORS, MODERATORS, RESPECTIVE AFFILIATES, AGENTS, OFFICERS, DIRECTORS, EMPLOYEES AND SOFTWARE LICENSORS HARMLESS FROM ANY CLAIM, DEMAND, LOSS, COSTS OR EXPENSE, INCLUDING ATTORNEYS' FEES, MADE BY ANY THIRD PARTY DUE TO OR ARISING OUT OF CONTENT YOU MADE AVAILABLE THROUGH THE SERVICE, YOUR VIOLATION OF THE RULES OF TERMINATION, YOUR VIOLATION OF THE TERMS OF USE, YOUR VIOLATION OF THESE TERMS OF SERVICE, OR YOUR VIOLATION OF ANY OTHER PERSON'S RIGHTS, INCLUDING BUT NOT LIMITED TO INFRINGEMENT OF ANY COPYRIGHT OR VIOLATION OF ANY PROPRIETARY OR PRIVACY RIGHT.


Modifications

ImmigrationWatch.com reserves the right to modify these Terms of Service at any time without notice. You should always review these Terms of Service prior to using the services provided on the Web site to ensure that you have a current understanding of the Terms of Service.
